Conditions of use for the emdimo.co website
EMDIMO S.A.S., identified with Tax ID (NIT) 901.067.718-1 and domiciled in Bogotá D.C., Colombia (hereinafter "Emdimo"), offers through the website emdimo.co and associated domains (hereinafter "the Site") information about its design, development, and maintenance services for custom software.
1. Acceptance
Access to and use of the Site implies the full and unreserved acceptance of these Terms and Conditions. If the user disagrees with any of the terms set forth herein, they must refrain from using the Site.
2. Purpose of the site
The Site is informational in nature. Its purpose is to present the professional services offered by Emdimo and facilitate communication with prospects and clients through a contact form and a meeting scheduling calendar.
3. Intellectual property
All content on the Site (texts, graphics, logos, images, videos, source code, design, trademarks, and other elements) is the property of Emdimo or its respective owners and is protected by Colombian laws and international treaties on copyright and industrial property, in particular Law 23 of 1982, Andean Decision 351 of 1993, and Andean Decision 486 of 2000.
The reproduction, distribution, modification, public communication, or any other act of exploitation, in whole or in part, of the content of the Site without express written authorization from Emdimo is prohibited.
4. Permitted use
The user agrees to use the Site in accordance with the law, morality, and good customs. In particular, the following is prohibited:
- Using the Site for unlawful purposes or in ways that infringe third-party rights.
- Performing actions that may damage, overload, or impair the Site or hinder its normal operation.
- Attempting to access restricted areas or circumvent technical security measures.
- Collecting data from other users through automated or unauthorized means.
5. Professional services
Information published on the Site about Emdimo's services does not constitute a binding commercial offer under Article 845 of the Colombian Commercial Code. The provision of professional services by Emdimo shall be governed by an independent contract, signed between the parties, defining scope, deadlines, prices, payment conditions, and other specific terms applicable to each project.
6. Contact form and personal data
Submission of information through the contact form implies acceptance of the Privacy Notice and authorization for the processing of personal data in accordance with Colombian Law 1581 of 2012 and its Regulatory Decree 1377 of 2013.
7. Limitation of liability
Emdimo does not guarantee the uninterrupted availability and continuity of the Site. Within the limits permitted by Colombian law, Emdimo shall not be liable for:
- Damages or losses arising from the use of or inability to use the Site.
- Errors or omissions in the content of the Site.
- Service interruptions, viruses, or technical failures caused by reasons outside of Emdimo.
- Content published on external sites linked from the Site.
8. Third-party links
The Site may contain links to third-party websites or services (including but not limited to Google Calendar). Emdimo is not responsible for the content, privacy policies, or practices of such third parties. The use of those services is governed by their own terms.
9. Modifications
Emdimo reserves the right to modify these Terms and Conditions at any time. Modifications shall take effect from the moment of their publication on the Site. Users are encouraged to review them periodically.
10. Applicable law and jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Colombia, in particular Law 527 of 1999 (electronic commerce and digital signatures), the Commercial Code, the Consumer Statute (Law 1480 of 2011), Law 1581 of 2012 (personal data protection), and other applicable regulations.
Any controversy arising from the interpretation or execution of these Terms shall be submitted to the competent judges and courts of the city of Bogotá D.C., Colombia, with express waiver of any other jurisdiction that might apply.
